Privacy Policy.

This Privacy Policy applies to the red firm, the law firm operated by Anis Bendimred, avocat à la Cour and member of the Luxembourg Bar, whose office is located at 6D, Route de Trèves, L-2636 Senningerberg (the "Firm").
This Privacy Policy is issued in accordance with (i) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR"), (ii) the Luxembourg Law of 1 August 2018 implementing the GDPR and establishing the National Commission for Data Protection ("CNPD"), (iii) the Luxembourg Law of 10 August 1991 on the legal profession, and (iv) all other applicable laws and regulations (all together, the "Data Protection Law").
For the purposes of the Data Protection Law, Anis Bendimred acts as controller for personal data processed by the Firm.
01/ What personal data we process.
We may process identity and contact details, professional and organisational information, matter-related data, billing and payment details, communications, website and technical data, recruitment data, and, where necessary, special category data or data relating to criminal offences.
02/ Why we process your data.
We process personal data to:

respond to enquiries and carry out conflict checks;

provide legal advice, representation and related services;

manage client, supplier and professional relationships;

comply with legal, regulatory, professional and AML obligations;

protect the Firm’s rights and interests;

operate and secure our website and IT systems; and

manage recruitment and collaboration matters.
03/ Legal bases.
Depending on the circumstances, we rely on:

performance of a contract or pre-contractual steps;

compliance with legal obligations;

legitimate interests, including operating a secure and effective legal practice;

establishment, exercise or defence of legal claims; and

consent, where required, for example for certain marketing activities or cookies.
04/ Professional secrecy and confidentiality.
As a Luxembourg attorney-at-law (avocat à la Cour), Anis Bendimred, together with any person working for or with the Firm, is bound by professional secrecy and strict duties of confidentiality.
Personal data received in connection with legal advice, representation or a client matter is handled subject to those obligations. Nothing in this Privacy Policy limits or overrides professional secrecy.
Where disclosure would breach professional secrecy, the rights of another person, or applicable legal requirements, access to information or documents may be refused or limited.
05/ Recipients.
We may share personal data, where necessary and lawful, with:

our staff, collaborators and service providers;

clients and counterparties;

courts, arbitral tribunals, public authorities, regulators and the Luxembourg Bar;

experts, translators, notaries, bailiffs, auditors, accountants, fiduciaries and insurers; and

IT, hosting, cybersecurity, document-management and communication providers.
Service providers process data only on our instructions and under appropriate confidentiality and security safeguards.
06/ International transfers.
Some matters may require transfers outside the European Economic Area. Where needed, we use an appropriate transfer mechanism permitted by the GDPR, such as standard contractual clauses or another lawful mechanism, together with additional safeguards where appropriate.
07/ Retention.
We keep personal data only as long as necessary for the relevant purpose and to comply with legal, professional, accounting, tax, conflict-check and claims-preservation obligations. Where data is no longer needed, it is securely deleted, anonymised or archived where required by the Data Protection Law.
08/ Your rights.
Subject to applicable law and professional secrecy, you may request access, rectification, erasure, restriction, objection and, where applicable, data portability. Where processing is based on consent, you may withdraw consent at any time. You also have the right to lodge a complaint with the CNPD. The CNPD’s powers of access vis-à-vis lawyers are themselves exercised under the rules protecting professional secrecy.
